EEOC Says Restaurant Chain Punished Female Employees Who ComplainedLOS ANGELES – The U.S. Equal Employment Opportunity Commission (EEOC) today announced the resolution of its class action employment discrimination lawsuit against Specialty Restaurants Corporation, an Anaheim, Calif.-based owner and operator of restaurants and banquet facilities nationwide, including Monterey Hill Banquets in Monterey Park, Calif. Under the EEOC settlement, the company has agreed to pay $625,000 to claimants and will adopt remedial measures to ensure that its employees are not sexually harassed.

U.S. Department of Labor’s OSHA proposes more than $94,000 in penalties following inspection of construction trench in Atlanta
ATLANTA — The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) has proposed $94,250 in penalties for seven safety violations after inspecting an Atlanta worksite on Fulton Industrial Boulevard where employees of two construction contractors were installing storm drainage and sewer lines.
OSHA cited with two repeat safety violations and proposed penalties of $75,000. Company violations include exposing employees to cave-in hazards by placing excavated material within two feet of the trench and allowing employees to work in an 18-foot-deep trench without an adequate protective system. The company also has been cited with one serious violation carrying a $7,000 proposed penalty for not providing employees with a means of egress from the trench. Read the rest of this entry »

EEOC: Company to pay $250,000 in race discrimination settlement
The U.S. Equal Employment Opportunity Commission (EEOC) announced the settlement of a race discrimination lawsuit against a bottling company for $250,000 on behalf of an African American former worker in Albuquerque, N.M. The resolution follows a favorable ruling by the U.S. Court of Appeals for the 10th Circuit, which established an important legal doctrine known as “subordinate bias” theory.
The EEOC had charged the company with committing race discrimination against a black merchandiser when a supervisor fired him in 2001 for not working his scheduled day off, even though the employee had called in sick and provided medical documentation. A Read the rest of this entry »
